Relying only on the Form 1099-DA provided by an exchange can be a costly mistake. These forms often present an incomplete picture, omitting useful cost basis details for transferred-in assets. The IRS receives a copy of this form, and if the basis is missing, they may assume it is zero, triggering an incorrect and often inflated tax assessment.

The 40% exclusion follows the federal net long-term figure
North Dakota's 2025 individual booklet provides a 40% exclusion for qualifying net long-term capital gain. Its worksheet begins with the relevant net long-term amounts from federal Schedule D, uses the smaller applicable figure, and multiplies it by 40%. This is not 40% of sale proceeds, and it is not calculated one wallet at a time. A complete federal short-term and long-term rollup must exist before the state worksheet can be applied correctly.
